Florida's Telephone Solicitation Act: an automated promotional text needs the customer's prior express written consent; promotions go only between 8am and 8pm; and no more than three reach one person in 24 hours. $500 a violation, $1,500 if willful. Barker sends nothing - it is the check before your texting service does.

Written consent is a signed agreement - an electronic signature counts - that names the business, authorises it to text that number with an automated system, and says consent is not a condition of buying anything. A sign-up under wording missing any of those does not count.
