Poolkeep Tip Pool Rule Check
For clubs that pool tips among bartenders, servers, bar-backs and floor staff

The manager helped on the bar. He still can't share.

Poolkeep checks who is in tonight's pool against the federal rule and your state's before it is split, splits it by hours to the cent, and keeps every night on record.

Opens in this browser with an invented club already in it. No account, no email address, nothing installed. Never holds a customer's name, a card number or a bank account.

The problem

One wrong name in the pool is back pay for all of it.

Since 2018 no manager or supervisor may share in a tip pool, and back-of-house staff only when no tip credit is taken. California and New York go further. The pool gets split at 3am by whoever is closing.

2018

the FLSA amendment that bars employers, managers and supervisors from tip pools.

Tip credit

taken? Then back-of-house staff stay out of the pool.

State law

can be stricter - New York keeps back-of-house out whatever the wage.

Davis Wright Tremaine →

Will not split an unlawful pool.

Not a reminder. Split the pool refuses an owner, a manager or supervisor, a cook while a tip credit is taken, or anyone your state bars. The shares add up to the pool to the cent. A tip credit is refused in a state that allows none. A pooled night is never changed. There is no override.

How it works

Staff, rules, pool

List the staff

Role and duties - who manages, who directs, who hires.

Set the rules

Your state, and whether you take a tip credit.

Split the pool

Tick who worked and their hours; the shares come out to the cent.

What it will never do

It keeps the pool. Never the customers.

Poolkeep holds staff, hours and shares, nothing more.

No customer names.Tips are totals, not who left them.
No card numbers. It never touches a payment.
No bank accounts.Payroll pays the shares.
It is not legal advice.A borderline supervisor is a question for counsel.

Questions

The ones we actually get asked

Can a shift lead share?

Yes, unless they meet the whole manager test - primary duty management, directing two or more, and hiring and firing.

Can the kitchen share?

Only if you pay everyone the full minimum wage with no tip credit - and not in New York.

How is the split worked out?

By hours. Leftover cents go to the largest remainders so every dollar is paid out.

Is this legal advice?

No. It is the record and the gates.

What do I actually get when I pay?

The demo on this page is the whole program, running on invented records. Paying gets you a licence key — one line of text, on your screen as soon as the payment confirms: the checkout brings you back to our thank-you page, you type your business name and the key appears. Paste it into the program and from then on it keeps your own records. Until then, nothing you type into it is kept.

The key is checked inside the page, on your own machine. It never calls us, so there is still no account and nothing about your business goes anywhere. If you ever stop paying, your records stay exactly where they are, read-only, and Export still hands you every one of them.

An invented club's floor manager is on the staff list - and Poolkeep will not let tonight's pool be split with him in it.
